This is a translation of the Dutch "Algemene voorwaarden". In the event of any difference or dispute, the Dutch version is legally binding.
Article 1 – Definitions and applicability 1.1. These general terms and conditions apply to all offers, quotations, orders, sales, purchases, deliveries and other agreements of EVE Gold, unless otherwise agreed in writing. 1.2. These terms apply to transactions through the physical shop, webshop, telephone, e-mail and other sales channels offered by EVE Gold. 1.3. EVE Gold trades in physical precious metals, including gold and silver bars, coins, jewellery, investment products and used precious metals. 1.4. A consumer means a natural person acting outside their trade, business or profession. A business customer means a buyer acting in the course of a profession or business. 1.5. Deviating arrangements apply only when confirmed by EVE Gold. Mandatory consumer rights always continue to apply.
Article 2 – Products and product information 2.1. EVE Gold sells, among other things, investment gold, investment silver, gold and silver coins, jewellery and other precious metals. 2.2. Where relevant, products state the metal, the manufacturer, the purity, the weight and other important characteristics. 2.3. The fine precious metal weight is calculated from the gross precious metal weight and the purity. 2.4. Product images are for illustration purposes. Year, packaging, appearance and serial number may differ if the offer does not relate to a specific item. The delivered product must, however, meet the agreed specifications. 2.5. Certificates, serial numbers and original packaging are supplied insofar as they form part of the agreed product description. 2.6. When selling precious metal articles subject to hallmarking, EVE Gold complies with the applicable Dutch hallmarking regulations.
Article 3 – Prices and precious metal rates 3.1. Gold and silver prices depend on international precious metal markets and may change continuously. 3.2. The sale price may consist of the precious metal value, a product or manufacturing premium and any applicable taxes and costs. 3.3. Until a price has been definitively agreed in accordance with Article 4, it may change. 3.4. Once a fixed sale price has been validly agreed, it will not be changed unilaterally solely because the precious metal rate has risen or fallen. 3.5. For consumers, total prices including applicable VAT and mandatory costs are clearly shown before the order is placed. 3.6. EVE Gold may correct obvious pricing errors as long as no binding agreement has been formed. After an agreement has been concluded, the statutory rules on mistakes and defects of consent apply. A pricing error does not automatically entitle EVE Gold to increase the agreed price.
Article 4 – Orders and formation of the agreement 4.1. An order may be placed through the webshop, in the shop or through a sales channel accepted by EVE Gold. 4.2. An automatic acknowledgement of receipt of an online order does not necessarily mean that EVE Gold has already accepted the offer. 4.3. The agreement is formed at the moment of acceptance by EVE Gold, unless the ordering process clearly indicates another legally valid moment. 4.4. After acceptance, the agreed products, quantities, prices and other terms are confirmed. 4.5. Before acceptance, EVE Gold may refuse an order due to insufficient stock, an obvious error, insufficient customer details, a security risk or a justified compliance objection. 4.6. For online orders, it is clearly indicated that placing an order involves an obligation to pay.
Article 5 – Price fixing 5.1. Price fixing means locking in a precious metal price at an agreed moment. 5.2. A fixing determines the metal, the rate, the quantity, the applicable premium and the agreed total price. 5.3. The weight may be recorded as gross weight or fine precious metal weight, provided the basis of calculation is clear. 5.4. A confirmed fixing is binding, subject to statutory termination rights and expressly agreed conditions. 5.5. After a confirmed fixing, the customer cannot unilaterally demand a new rate due to subsequent market developments. 5.6. An agreed fixing may cover several product lines. Partial deliveries are possible if agreed.
Article 6 – Payments 6.1. EVE Gold only offers the payment methods available for the transaction concerned. 6.2. Possible payment methods are bank transfer, iDEAL/Wero, Bancontact, SEPA and permitted debit card or cash payments. 6.3. EVE Gold is not obliged to accept credit cards or other payment methods it does not offer. 6.4. A bank transfer must be paid within the term stated on the invoice or order confirmation. If a term of 48 hours has been agreed, that term applies. 6.5. A payment is received once the amount has actually and unconditionally been credited or has been validly confirmed by the payment provider. 6.6. A proof of payment or screenshot does not in itself constitute definitive proof of receipt. 6.7. EVE Gold may require advance payment for business transactions. For consumer purchases, the statutory limits on mandatory advance payment apply: in principle, a consumer cannot be required to pay more than 50% of the purchase price in advance. Voluntary full advance payment remains possible. 6.8. The remaining amount is due at the agreed payment moment, at the latest in accordance with the delivery and payment arrangements made.
Article 7 – Cash payments 7.1. EVE Gold only accepts cash payments within the statutory limits and its published acceptance policy. 7.2. Cash payments of €3,000 or more are prohibited. EVE Gold applies an internal limit of no more than €2,999 per customer, for both purchases and sales. 7.3. It is not permitted to artificially split a transaction to circumvent the statutory limit. 7.4. The prohibition applies both to cash payments to EVE Gold and to cash payments by EVE Gold when purchasing goods. 7.5. EVE Gold may refuse cash payments where identification, source checks, security checks or other justified circumstances give reason to do so, insofar as permitted by law. 7.6. Any additional charges for cash payment, including the surcharge of 3% intended by EVE Gold, are only applied if they are lawful, clearly stated before the agreement and included in the total price.
Article 8 – Payment charges and payment security 8.1. EVE Gold does not charge a payment surcharge where applicable law prohibits this, including for regular consumer debit card payments. 8.2. Only payment charges that are permitted by law and disclosed in advance may be passed on. 8.3. EVE Gold may require that a payment comes from a bank account in the name of the contracting customer. 8.4. Payments by third parties are, in principle, not accepted. 8.5. Suspicious or unverifiable payments may lead to postponement of performance for as long as there are justified grounds for this. 8.6. Any refunds are, in principle, made via the original payment method or to a verified account of the entitled party.
Article 9 – Identification and customer due diligence 9.1. EVE Gold may require customers to have their identity verified where this is necessary for legislation, fraud prevention or a justified security check. 9.2. Business customers may be asked for additional information, including trade register details, VAT details and information about representatives and ultimate beneficial owners (UBOs). 9.3. Where necessary, EVE Gold may investigate the identity, the source of funds, the origin of precious metals and the purpose of a transaction. 9.4. Where required by law, data is recorded and retained in accordance with the applicable retention periods. 9.5. EVE Gold does not make copies or scans of identity documents without a legal basis. 9.6. EVE Gold may refuse or suspend transactions if necessary verification information is missing, provided the customer's applicable statutory rights are respected.
Article 10 – Anti-money laundering, sanctions and fraud 10.1. EVE Gold complies with the obligations applicable to its activities regarding anti-money laundering, sanctions regulations and fraud. 10.2. Customers may not use a false identity or carry out transactions on behalf of a hidden third party. 10.3. Circumventing payment limits, using incorrect information or concealing the true beneficial owner is not permitted. 10.4. In suspicious circumstances, EVE Gold may carry out additional verification and inform the competent authorities where required or permitted by law. 10.5. EVE Gold does not disclose confidential information about any statutory reports where disclosure is prohibited.
Article 11 – VAT and tax treatment 11.1. Investment gold that meets the statutory conditions is exempt from VAT. 11.2. Silver and other non-exempt products are subject to the applicable VAT rate. In the Netherlands this is generally 21%. 11.3. Used jewellery and other second-hand products may fall under the margin scheme, subject to the statutory conditions. 11.4. The margin scheme is not applied to products for which it is excluded by law, including unworked precious metals. 11.5. The tax treatment is determined per product or product line. 11.6. For international deliveries, the applicable rules of the country of delivery and the relevant European or national tax legislation apply. 11.7. Invoices state the correct tax treatment, including the VAT exemption for qualifying investment gold or the special scheme for second-hand goods, where applicable.
Article 12 – Stock, availability and pre-orders 12.1. Products may be available immediately or have a longer delivery time. 12.2. EVE Gold states a relevant delivery time before the customer enters into the agreement. 12.3. For certain products, an agreed delivery time of up to approximately four weeks may apply. 12.4. For pre-orders, availability, price arrangements and the expected delivery date are clearly agreed. 12.5. EVE Gold informs the customer of expected delays. 12.6. If EVE Gold does not deliver within the agreed period, the consumer retains their statutory rights to performance, an additional delivery period and, where applicable, termination and refund.
Article 13 – Delivery options and shipping costs 13.1. Depending on the product and destination, EVE Gold offers the following delivery methods: • Standard shipping: €7.95, without additional shipping insurance. • Additionally insured shipping: €19.95, only for products and risks actually covered under the conditions of the insurer used. • Collection in the shop: free of charge. • High-value secured shipping via CargoShield or a comparable carrier: from €69.95, in accordance with the applicable order, weight and insurance conditions. 13.2. Free standard shipping may be offered for orders from €2,500 in accordance with the published policy. 13.3. The final shipping options, coverage and prices are shown before the order is placed. 13.4. For particularly valuable products, EVE Gold may offer only certain secured shipping methods, provided this restriction has been disclosed before purchase. 13.5. The term 'insured' is only used where applicable insurance coverage has actually been established. Paid shipping insurance does not replace EVE Gold's statutory responsibility.
Article 14 – Shipping risk and delivery 14.1. For consumer purchases, EVE Gold remains responsible for loss or damage during transport until the product has been delivered to the consumer or a third party designated by them, in accordance with the law. 14.2. Choosing standard shipping without additional insurance does not limit this statutory responsibility. 14.3. If the consumer independently engages a carrier not offered by EVE Gold, different statutory rules on the transfer of risk may apply. 14.4. A different transfer of risk may be agreed in writing with business customers. 14.5. EVE Gold may use signature on receipt, identification, secured courier services or other appropriate delivery measures. 14.6. A tracking status counts as evidence, but is not in all circumstances conclusive proof that a consumer actually received the order.
Article 15 – Loss, theft and damage during transport 15.1. The customer should report a missing item or visible damage to EVE Gold as soon as possible, without losing mandatory rights in the event of a later report. 15.2. EVE Gold investigates transport incidents and, where necessary, contacts the carrier or insurer. 15.3. The customer may be asked to provide relevant information, photos or a statement about the incident. 15.4. For consumer purchases, the customer does not have to handle a claim against the carrier themselves to retain their statutory rights against EVE Gold. 15.5. In the event of loss or damage, the customer's statutory rights to performance, replacement, termination, refund or compensation are respected.
Article 16 – Collection in the shop 16.1. Customers can collect products at the agreed collection time. 16.2. To prevent fraud, EVE Gold may require an order confirmation and appropriate identification. 16.3. Collection by an authorised representative is only possible with prior approval and sufficient verification. 16.4. The customer may be asked to sign for receipt. 16.5. For consumer purchases, risk passes in accordance with the statutory rules at the moment of actual delivery. 16.6. Products that are not collected for a long period are handled in accordance with reasonable arrangements disclosed in advance. Mandatory rights continue to apply.
Article 17 – Statutory right of withdrawal 17.1. For distance contracts, consumers in principle have a statutory cooling-off period of 14 days. 17.2. This cooling-off period does not apply to products whose price depends on fluctuations in the financial market over which EVE Gold has no influence, such as qualifying investment gold or investment silver. 17.3. The exception is only applied where the product concerned and the agreement actually meet the statutory conditions. 17.4. For non-excluded products, for example certain jewellery with a fixed sale price, the statutory right of withdrawal continues to apply. 17.5. For purchases concluded exclusively in the physical shop, there is no general statutory right of withdrawal due to regretting the purchase. 17.6. Before purchase, EVE Gold clearly informs the customer whether or not a right of withdrawal exists.
Article 18 – Withdrawal and return of non-excluded products 18.1. For products to which the right of withdrawal applies, the consumer may withdraw from the agreement within the statutory period. 18.2. The customer can do so by e-mail, using the statutory model form or the applicable online withdrawal function. 18.3. The consumer returns the product within the statutory return period, unless otherwise agreed. 18.4. The direct costs of return are only borne by the consumer where this is permitted by law and correctly communicated in advance. 18.5. EVE Gold refunds amounts due within the statutory period and may, where permitted, wait until the return has been received or sufficient proof of shipment has been provided. 18.6. The consumer may be liable for any reduction in value resulting from handling beyond what is necessary to assess the product. 18.7. Opening packaging or breaking a seal does not automatically void statutory warranty rights.
Article 19 – Cancellation of rate-linked precious metal orders 19.1. After an agreement concerning rate-linked precious metals has been validly concluded, the customer cannot cancel free of charge because of an unfavourable rate development where the statutory right of withdrawal is excluded. 19.2. EVE Gold may voluntarily agree to a cancellation on request. 19.3. If cancellation is permitted, the parties may agree on reasonable compensation for rate losses actually incurred and demonstrable costs, insofar as permitted by law. 19.4. The rate difference may be assessed on the basis of the originally agreed rate and an objectively verifiable market rate at the agreed settlement moment. 19.5. Any additional cancellation fee of 5% is not applied automatically. It requires a legally valid, proportionate basis agreed in advance. 19.6. No double compensation is charged for the same loss. 19.7. Statutory rights in the event of shortcomings by EVE Gold continue to apply in full.
Article 20 – Cancellation by EVE Gold 20.1. EVE Gold may only terminate an agreement where there is a valid statutory or contractual ground for doing so. 20.2. Possible circumstances include a statutory impediment to delivery, a well-founded suspicion of fraud, non-performance after a required notice of default or a valid invocation of force majeure. 20.3. An ordinary rise in market prices does not in itself entitle EVE Gold to terminate a binding agreement. 20.4. Upon termination, amounts received are refunded insofar as EVE Gold may not validly set them off or retain them.
Article 21 – Late payments and collection costs 21.1. Customers must meet the agreed payment obligations on time. 21.2. In the event of payment arrears, EVE Gold informs the customer in accordance with the statutory rules. 21.3. For consumers, extrajudicial collection costs are not charged earlier than permitted by law, including after a correct fourteen-day reminder. 21.4. EVE Gold may charge the applicable statutory interest and permitted collection costs. 21.5. Different written payment and default arrangements may apply to business customers. 21.6. A missed payment does not automatically give the right to change an agreed gold price retroactively.
Article 22 – Retention of title 22.1. Insofar as permitted by law, delivered products remain the property of EVE Gold until the relevant payment obligations have been met. 22.2. Retention of title applies only within the limits of the applicable legislation. 22.3. EVE Gold ensures that it has the right to transfer the agreed ownership of the products sold to the buyer. 22.4. For business transactions, additional arrangements may be made regarding retention of title and security.
Article 23 – Quality, authenticity and statutory warranty 23.1. EVE Gold guarantees that delivered products conform to the agreement and the statutory conformity requirements. 23.2. The agreed purity, metal, weight and product description form part of this obligation. 23.3. In the event of justified complaints about deviations, EVE Gold offers a solution in accordance with the statutory warranty rules. 23.4. A manufacturer's certificate or factory warranty does not limit EVE Gold's statutory responsibility. 23.5. Normal market price decreases are not regarded as a quality defect. 23.6. A general exclusion of warranty or liability does not apply to rights from which no deviation is permitted by law.
Article 24 – Purchase of used gold and silver products 24.1. EVE Gold buys, among other things, used jewellery, coins, scrap gold and other permitted precious metals. 24.2. When purchasing, the weight, the purity, the relevant market price and any processing costs are assessed. 24.3. The final purchase price is determined with the seller before the purchase agreement is concluded. 24.4. Gemstones, base metals, watch parts and other materials may fall outside the precious metal valuation. 24.5. EVE Gold may use testing methods to determine the precious metal content. 24.6. Prior consent is obtained for destructive tests or actions that cause permanent damage. 24.7. If the parties agree on a provisional valuation, the conditions for the final determination are agreed in writing.
Article 25 – Ownership and origin when purchasing precious metals 25.1. Anyone who sells precious metals to EVE Gold declares that they are authorised to sell them. 25.2. The seller declares that the goods offered do not originate from theft, fraud or other criminal acts. 25.3. EVE Gold may request information about the origin of the goods offered and may carry out necessary registrations. 25.4. When purchasing second-hand goods, the applicable rules for the dealers' register (opkopersregister) and municipal retention periods are observed. 25.5. A purchase may be refused if there is insufficient clarity about ownership, origin or identity. 25.6. EVE Gold may inform the competent authorities where there is a statutory obligation or other lawful ground to do so.
Article 26 – Payment on purchase 26.1. The purchase price is paid in accordance with the agreed payment method. 26.2. Bank payments are, in principle, made to an account in the seller's name. 26.3. Cash payments are also subject to the statutory limit of €3,000 and EVE Gold's internal policy. 26.4. EVE Gold may suspend payment where a justified verification permitted by law is necessary. 26.5. Once a purchase has been definitively agreed, the parties are bound by it, subject to statutory rights or expressly agreed conditions. 26.6. Arrangements regarding any additional testing, refining and final price determination must be made clear in advance.
Article 27 – Purchase, buy-back and resale of investment precious metals 27.1. EVE Gold is not automatically obliged to buy back previously sold precious metals, unless a separate buy-back agreement has been concluded. 27.2. Any buy-back price is determined at the moment and under the conditions of the new transaction. 27.3. A buy-back price may differ from the original sale price due to market developments, premium differences, product condition and costs. 27.4. On buy-back, EVE Gold may check the authenticity, weight, purity and condition of a product. 27.5. The applicable identification, payment and registration rules also apply to buy-back transactions.
Article 28 – International orders 28.1. EVE Gold currently focuses its webshop shipping on the Netherlands, Belgium and Germany. 28.2. The availability of shipping to a country is clearly stated before purchase. 28.3. EVE Gold may apply additional delivery and identification requirements where these are necessary and lawful. 28.4. Any customs formalities, import duties and taxes are handled in accordance with the statutory rules and the delivery terms agreed before purchase. 28.5. National delivery restrictions may not be applied in a way that conflicts with applicable European rules against unjustified geo-blocking. 28.6. Mandatory consumer protection of the applicable country remains in force.
Article 29 – Business customers and wholesale 29.1. EVE Gold may offer separate business rates, volume discounts, supplier arrangements and fixing terms. 29.2. Business prices may be shown excluding VAT where this is clear. 29.3. For business transactions, arrangements may apply regarding full advance payment, credit terms, partial deliveries and transfer of risk. 29.4. Individual business arrangements agreed in writing take precedence where they validly deviate from these terms. 29.5. Supplier, consignment and wholesale agreements may contain separate terms. 29.6. Business exceptions do not apply to consumer purchases.
Article 30 – Consignment and third-party goods 30.1. EVE Gold may sell products that it holds under a consignment agreement with a supplier. 30.2. Consignment arrangements between EVE Gold and its supplier are regulated separately. 30.3. The use of consignment does not affect consumers' contractual and statutory rights against EVE Gold as the seller. 30.4. EVE Gold ensures valid delivery and transfer of ownership to the buyer in accordance with the agreed transaction.
Article 31 – Complaints procedure 31.1. Customers can submit complaints via info@evegold.nl or via the contact channels published by EVE Gold. 31.2. EVE Gold aims to respond substantively within a reasonable period and informs the customer of any delay. 31.3. Complaints about weight, purity, missing products, damage or delivery are carefully investigated. 31.4. The customer may be asked to provide relevant photos, invoices, serial numbers and other supporting documents. 31.5. Submitting a complaint does not limit any statutory rights to repair, replacement, termination or compensation.
Article 32 – Personal data and privacy 32.1. EVE Gold processes personal data for order processing, payments, delivery, customer service, administration, fraud prevention and legal compliance. 32.2. Personal data is only processed on a valid legal basis. 32.3. EVE Gold may share necessary data with payment providers, carriers, administrative service providers or competent authorities. 32.4. Retention periods are determined in accordance with the GDPR (AVG) and applicable statutory record-keeping obligations. 32.5. Customers can exercise their privacy rights insofar as these apply. 32.6. Further information is provided in EVE Gold's separate privacy statement.
Article 33 – Security and misuse 33.1. EVE Gold may apply reasonable security measures to protect customers, employees, products and payment transactions. 33.2. Misuse of the webshop, fraudulent orders, identity fraud and unauthorised access are prohibited. 33.3. EVE Gold may take appropriate measures in the event of serious security incidents, in accordance with the law. 33.4. Any camera surveillance and the processing of personal data obtained through it are governed by applicable privacy legislation.
Article 34 – Liability 34.1. EVE Gold is liable for shortcomings and damage insofar as this follows from the law or the agreement. 34.2. Statutory consumer rights and liability that may not be excluded remain fully preserved. 34.3. A fall in the market price of precious metals does not in itself constitute grounds for compensation. 34.4. For business agreements, reasonable limitations of liability permitted by law may be agreed separately. 34.5. EVE Gold does not exclude liability for intent, deliberate recklessness or other liability that cannot be excluded by law.
Article 35 – Force majeure 35.1. Force majeure means circumstances in which a shortcoming cannot be attributed to EVE Gold under the law. 35.2. Depending on the specific circumstances, this may include exceptional government measures, serious transport disruptions, natural disasters or other external events. 35.3. An ordinary rate fluctuation, insufficient stock or normal supplier delay does not automatically constitute force majeure. 35.4. In the event of force majeure, EVE Gold informs the customer and the statutory consequences for performance, termination and refund are respected.
Article 36 – Investment risk and information 36.1. Precious metals can fluctuate strongly in value. 36.2. Past results are no guarantee of future price developments. 36.3. EVE Gold does not guarantee profit, return or future buy-back value. 36.4. General information about precious metals is not automatically personal investment advice. 36.5. The customer remains responsible for their own investment decisions, without prejudice to EVE Gold's statutory information and duty-of-care obligations.
Article 37 – Applicable law and disputes 37.1. Dutch law applies to agreements with EVE Gold, insofar as a valid choice of law is possible. 37.2. For consumers in other countries, the mandatory protective rules that cannot be excluded by a choice of law under applicable private international law continue to apply. 37.3. Disputes are preferably first dealt with through mutual consultation. 37.4. If a dispute is not resolved, it may be submitted to the competent court under the law. 37.5. For business disputes, insofar as permitted by law, the competent court in the district of Rotterdam may be designated.
Article 38 – Amendments and final provisions 38.1. EVE Gold may amend these general terms and conditions for future agreements. 38.2. An existing agreement is governed by the version that validly applied when it was concluded, unless the parties agree otherwise or the law provides otherwise. 38.3. If a provision proves to be invalid or unenforceable, the remaining provisions remain in force insofar as legally possible. 38.4. Mandatory statutory provisions always take precedence over conflicting terms. 38.5. These terms are made available in an accessible and durable manner before the agreement is concluded.
